 	 				refusal of dla was created by maryanne			
  			 				my husband has been refused dla even though he has had it for the past 2 years he is now 65 and they are saying that he is now not eligable even though he previously qualified. his condition is degenerative and they seemed to have ruled this out and as good as said he is now fit and well despite reports from consultants and GP we are going to appeal and are wondering if anyone can help thanks

  			 				If he has been getting DLA before he reached 65, his age is not a bar to his continuing to get it.

  			 				According to the DWP website you are only eligible for DLA up the age of 65 after that you have to claim Attendance Allowance. I have been unable to find whether the transfer is automatic or whether you need to appply for AA.

I thought if you had DLA before 65 you could have it after 65 but no new claims also after 65 only care not mobility

  			 				Dave is right - if your DLA claim starts before you reach the age of 65, you can continue to receive it after you reach 65.
 
Once you are over 65, you need to keep claiming it, because if you have a break of more than a year in your claims, you cannot renew it.

You may be correct. I've reference to this on several other sites but nothing at the DWP, just the below/above 65 boundary.
 
Any other mods know the answer to this?
