Claimants have been left in a state of deep uncertainty over the government’s response to the work capability assessment (WCA) consultation.  In particular, they want to know what is happening to reassessments for claimants in the support group for employment and support allowance (ESA) or who have limited capability for work-related activity (LCWRA) for universal credit (UC).

The government’s response document gives contradictory messages about whether reassessments for this group, who we will call the LCWRA group to include both ESA and UC, have already ended or whether they will not end until 2025.

The government’s proposals introduce something called the Chance to Work Guarantee.

The Chance to Work Guarantee “is for existing claimants on UC and ESA with LCWRA. This change will be effective from 2025, at the same time as WCA changes are introduced. This change will in effect abolish the WCA for the vast majority of this group, bringing forward a key element of our White Paper proposals and giving people the confidence to try work.”

The meaning of this paragraph seems clear: the abolition of the WCA for existing LCWRA claimants will take place in 2025.

However, in the next paragraph the government states:

“These changes will mean that almost all people who are currently assessed as having LCWRA will never face a WCA reassessment again. Reassessments will only take place under very limited circumstances, which are:

  •  When a claimant reports a change of circumstances in their health condition;
  • If a claimant has been awarded LCWRA for pregnancy risk, or cancer treatment where the prognosis for recovery is expected to be short-term;
  • If a claimant has been declared as having LCWRA under the new risk provisions; and
  • In cases of suspected fraud.”

The phrase “currently assessed as having LCWRA” suggests that almost all current claimants are now safe from reassessment.

Is this simply because there are very few WCA reassessments taking place, so almost all current claimants will not be reassessed anyway?  

Or because a firm decision has been made to end reassessments immediately for people with LCWRA?

At the end of the response document, readers are told:

"Changes to the WCA activities and descriptors will be implemented nationally, no earlier than 2025.

"We want claimants who have already been assessed as having LCWRA to be able to engage with support to move towards work without the fear of reassessment. We have committed to ensuring no one currently assessed as having LCWRA will face a WCA reassessment, save in some exceptional circumstances. This will in effect abolish the WCA for this group, bringing forward a key element of our Health and Disability White Paper proposals and give people the confidence to try work."

The phrase “no one currently assessed as having LCWRA will face a WCA reassessment” seems unambiguous in saying that the WCA has already ended for claimants with LCWRA and it is just changes to the activities and descriptors which will have to wait until 2025.

We wish that we could tell readers categorically what the right answer is.  But the truth is that we don’t know, although we are making strenuous efforts to find out.

There are some of our readers’ questions that we can answer, however.

Mass reassessments

One suspicion that was raised repeatedly when we covered the chancellor’s Autumn statement was that all current LCWRA claimants would be reviewed before 2025 and most would be pushed into the LCW group in advance of the changes.

We can say with some certainty that this won’t happen.

For one thing, there is virtually no possibility of Maximus being able to recruit, train and deploy the vast number of new health professionals that would be needed to reassess everyone who currently has LCWRA between now and 2025.

In addition, figures from December 2022 show that the percentage of DWP decisions for repeat WCAs was:

  • 83% of outcomes for Support Group
  • 13% of outcomes were for Work Related Activity Group
  • 4% of outcomes were found Fit for Work

So, even if the DWP were to reassess all LCWRA claimants before the reformed WCA was introduced, the vast majority would remain in the LCWRA group.  And any appeals would be heard under the rules that applied at the time of the decision, even if the hearing took place when the reformed rules were in place.

Compulsory Chance to Work Guarantee

Another concern that a number of readers raised was that the Chance to Work Guarantee would make it compulsory for existing claimants with LCWRA to try work or work preparation.

This seems extraordinarily unlikely and would undoubtedly require further changes to the law. 

Even under the new proposals the government recognises that there are some claimants for whom any move towards work would be potentially seriously harmful.  A mandatory requirement to try work for current LCWRA claimants would be too dangerous for any administration to consider.

Stay safe

The reality is that if this change comes about, whether it applies now or in 2025, the vast majority of current LCWRA claimants will never have another reassessment because so few are being carried out.

But that does nothing to take away the fear for individual claimants who might be one of the unlucky ones if reassessments are continuing.

We will continue to try to get clarification.

But, in the meantime, we would advise readers to assume that reassessments are to continue until 2025 and that trying out work whilst in the LCWRA group could have serious consequences for your future benefit entitlement.

    I have LCWRA. After my two year appeal to have mobility element added on mental health grounds (finally successful in Jan this year) my award should have been until March 2024. I was made to do a review (without support) in July, less than 6 months after my tribunal. Following the telephone assessment (2.5hrs) in November, the low rate mobility it took me 2 years to get, has been removed.

    I've been wondering what happened to reassessment for years now. I successfully appealed against the ending of invalidity benefits (now ESA) about 7 years ago and the tribunal directed that I should not be reassessed for two years. The DWP, which had not attended the hearing, sent me a WCA assessment form a couple of weeks later; I had to insist that they withdrew that by showing them my copy of the tribunal decision.
    But had the DWP merely heeded the tribunal's direction, they could have begun re-assessment by January 2019 - and they never did.
    As I'm about to reach state retirement age, I hope that I'll never have to cope with another of those awful forms but I profoundly sympathise with anyone who has to do so. For anyone with chronic anxiety/depression, which the form (as I last saw it) almost ignores, attempting to show on the form why one remains unfit for work makes one feel much more ill than at any other time. The medical problem can be just about manageable but having one's face rubbed in one's own ill-health is impossibly distressing.

    I was due to have a UC LCWRA review way back in June 2023, as that's when I was told I'm up for review after my 2 year award.

    It's now December and I've heard nothing, so 6 months later than anticipated already.

    We had another review two months ago although it wasn't supposed to due for another 1yr , (which no decision has been made as of yet) she has full rate for PIP for both so obviously in the LCWRA group, when we enquired as to why so early they said it's because at the moment they are 44weeks behind, this is her 6th form in just over 2 and a half years. They have been told several times her condition is not going to improve but they constantly have sent "light reviews" which makes me laugh as it's still a substantial form. 
    So I don't think they have given up reviews as of yet.

      @John It’s not always working that way though , I had high mobility and have problems and easily qualify for the mobility 15 point . DWP completly ignored this and I had to go tribunal. Awarded Lcwra , which although have other health issues they said was mainly awarded on mobility . So all the time wasted could of been avoided although the back pay was nice 😂

    Hi Yes i'm having  to fill in the Form once again and No doubts have a ex-Paramedic or similar  Medical,i've lost count how many i've gone to over the 30+Years.i'm Currently in LCWRA Group but 2020 a Tribunal Judge told me i Shoiuld be in The Support Group!

    My granddaughter has just received her work capability form which I fill in on her  behalf as her “support worker”. It’s too much for my granddaughter. I have to return the form by 3rd January 2024.

    My 31 year old son with severe learning difficulties and physically disabled has been in the Support Group for 13 years and had never been reassessed.
    His condition will never improve and is progressive.
    However….a month ago, he received quite an intimidating letter with a short cut off date to fill in the lengthy forms and submit evidence. It said that his benefit would be stopped if not returned in time. The post is bad locally so we received it a week late and it’s not easy nowadays getting updated reports as GP, Consultants are so busy. It was stressful!
    Finally received the decision yesterday which stated that “ due to a recent change” they had looked at his case and he would be placed in the Support Group and receive ESA.
    He has been in the Support Group for 13 years. I have not reported any change in his condition or circumstances. It all seems very fishy! I suspect that they are trying to reassess and remove from Support so the additional payment would be lost.

    I get LCWRA and was due reassessment September 2022. Given the delays etc I was expecting to be contacted at some point in 2023 but so far, nothing. I'm quietly hoping they'll leave me alone and as long as they keep giving me the money I need, I won't rock the boat by asking about it!

      @Andrew Before covid they had a timescale of 1 to 3 years. But reassesments were suspended when covid hit and have been suspended ever since. They only started reassessing a small portion of random people a few month ago. But right now people have been on LCWRA FOR 3 4 5 + years without being sent for a reassesment. There is huge backlogs even if they did restart reviews fully, and obviously as you read above they might have been stopped permently.

    What happens if a person pushed says I don’t want your benefits - won’t they panic as they want to keep tabs on a person. My brother told them forget it take me off benefits I don’t want them your are pressuring me - they got flabbergasted saying oh don’t say that.

    I have sever mental health problems, including sever agoraphobia. i have just been awarded PIP because of my mental health. i am now getting more anxious and depressed worrying that i am going to be forced to go to work when i struggle to even leave the house unless i am with someone i know and trust, then i cant go far and can not be separated from them without having a melt down.  i am not trained to do any of the work from home jobs and am not able to retrain.  this announcement and the lack of clear information about who will and who wont be forced to work is making my and i am sure many others mental health spiral out of control.

    What's important here is not whether people are having reassessments at this moment. The government document clearly states: 'The commitment that no one with an existing LCWRA decision today will be reassessed, except in a few limited circumstances'.

    That day was the 22nd of November, so we need to know if anyone with a Support Group or LCWRA award has received an ESA/UC50 sent out after that date and if so under what circumstances.

    Sorry if that sounds rude but there seems to be a lot of confusion in these comments which is perfectly understandable given the woeful nature of the documents the government provided.

      @Stuart I'm in Support group since 2019 recently been told by jobcentre coach that people already on this type of. Benefit won't be re assessed except few limited circumstance. Everyone is confused it's put luck if you happen to be one of the unlucky ones to get picked

      @Louise George Hi Louise. The cut off date is usually 4 weeks after the date the reassessment form was sent out. Given yours was the 18th that would suggest it was sent out around the 20'th Nov, so before the Autumn Statement. Could that be right?

      @Victoria That's alarming as mine is due in March too! Do you mind if i ask you whether you are in the Support Group/LCWRA? And how you know it was meant to be March? ... ie did the DWP tell you that specifically? 

      Was it that you were told by them that reassessment would be March 24 & then you just received the form through the post 4 months early?... for no apparent reason?!

      @CC So would that mean that some of us could technically still have been referred before the budget ? Meaning we could still have the wca looming over us?

       Or are we usually notified by uc/esa as soon as you are referred? 

      Meaning if you haven’t already been notified as being referred either by post/uc journal before now then an assessment won’t be done?

      @Roger Mitchell @Roger You will be retired before any wca is acted upon.Absolute waste of time and money.Do they really imagine an employer is going to take someone on with 4 months to retirement and who’s sick as well.No need to worry,just fill in the form and play the game,you’ll soon be out of the system for good!

      @welshval Its uncertain at this point, because its very unlikely existing referrals will be cancelled and it can take weeks or even months from referral to getting a WCA.

      I think anyone getting a WCA before mid Dec was probably referred before the budget.

      @Roger Mitchell Many years ago I attended a WCA and a lady had gone in before me, she came out about 20 mins later and said very loudly 'That was just ridiculous, he did everything but look up my nose'! 'I'm due to retire in two weeks'! I always rem that ,I can still see her face too. So ,it seems this is pretty much the norm for those close to retirement, not entirely sure why. Maybe some of the others on here would have better insight.

    I'm well over-due for reassessment, having gotten the award for LCWRA in March of 2022 and the stated date for reassessment being just 1 year (March 2023). They clearly have so much backlog that a lot of us won't know whether it affects us until a Labour government is formed anyway.

    I think that anything from now would be paper based assessments because let's face it they haven't got the staff or contracts to do it it would cost millions to do so saving them money. And they'll only be wasting their time time to get the same results as previously pointless process of testing and retesting to get the same outcome. I mean th they said it would end in 2016/18 under Damien Green he was right about it. Under incapacity benifit people were left alone after a few assessments for decades to save time and money.  Most died before reaching pension age so another saving for the DWP

    The commitment that no one with an existing LCWRA decision today will be reassessed, except in a few limited circumstances, 

    This clearly uses the word today, published on the 22/11/23.

    So for me, this is saying that anyone from that date, with a lcwra decision will not face reassessment.

    I last filled out review paperwork for ESA in March 2017, and in June was re-awarded ESA Support Group. I was due to be re-assessed in March 2019, but then covid came along and this was obviously delayed. I have been sitting on tenterhooks ever since awaiting the brown envelope of doom. In September this year I applied for my State Pension and finally feel safe. But I did wonder myself if they had just stopped re-assessing people in the Support Group since they were so far behind with everything else. Obviously this will no longer apply to me, but I hope that many thousands of people will finally get some peace of mind, until that is they come up with another way to torture the long term sick/disabled. What does seem vastly unfair however is that current claimants may well avoid the future proposals regarding who decides if you are fit for work or not but that future ones may well be just as sick/disabled as those of us already in the Support Group but they may stand even less chance of being safe from trying to seek work than we have been!

      "Mr Green told the media : "If you have got a condition that has made you unfit for work and which can only stay the same or get worse, I think it is just pointless... to just bring someone back again" 

      That was October 2016 and most got reassessments sent to them up until 2018

    Currently meaning in the english dictionary - at present time.

    So could this not mean, that the present time is from now, until the changes come in to effect in 2025.

    Therefore they could be saying, that claimants who are reassessed during this time and placed in LCWRA. Will then have no further assessments in 2025, once the changes take place.

    As usual, instead of putting it clearly and concisely eg: All current claimants, who receive LCWRA, will from today, no longer face a WCA reassessment .
