Wow bro really! I had heard of couples claiming CA for each other but I didn't think it was a legal thing.

Yes, H already gets EDP.

Hi all

The letter has finally arrived to say that my husband can't claim carer's for me, & to say that I'm confused is an understatement! :blink:

Am I right in thinking that this means that he can't claim full carer's because he gets other benefits, but he can claim a carers premium instead because of the underlying entitlement thing?

If so, then what do we do next?

If your husband in receiving ESA(CB) then he won't receive CA as the two benefits overlap and as the ESA(CB) payment will be higher, only it will be paid, however, it will give an underlying entitlement to CA and should enable the payment of the Cares Premium, but only if your husband or you are receiving ESA(IR) either in whole or as a top up to your ESA(CB).

If you are not currently receiving any ESA(IR) then you may still be eligible subject to your personal circumstances. ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

If the CA has been denied for another reason then post again with more information and we will do our best to help.

Thanks Gordon.

The letter says that you are not entitled to CA because the person you are caring for did not get appropriate disability benefits. But I was told that my husband could claim because I'd recently got PIP Daily Living.

So should we now fill in another form, or just contact them & tell them that I am getting PIP Daily Living?

I would contact them again to tell them that you are receiving PIP Daily Living, providing your husband has been providing the necessary care, it should be possible to make the CA claim from the same date as the PIP was awarded from.
