Transferring from ESA to UC and getting stuck - help?

Thanks David. That's why I've been adding detail.

I just received notification that they've decided both the council funds for direct payment AND my mother's estate account are all my capital so have closed my claim.

I have no funds. The first UC payment was due next week. I'm not quite sure what I'm supposed to do now.

Help?

I don't remember if I replied to this already - sorry. I've just given them SO MUCH proof that I'm not the beneficial owner of any of this money. And they've ignored it all.

The icing on the cake was the journal entry from the decision maker, who said 'where it says to call us, use your journal' - recognising that phone calls don't work for me, as finally pinned on my journal at job centre appointment yesterday. 30 seconds later they closed my claim, which closed my journal.

Without this forum, and a friend who I hope will call for me on Monday. I would be utterly stuck. But I don't know what I'm going to do for money while asking them for review or appealing. I don't know the next step.

Grateful for any advice. Thanks.

In my first reply to you I intimated that this may happen owing to the value of the flat.
You now will need personal assistance and maybe an advocate from a local Welfare Rights organization. If you tell me your town or city I will try and signpost you to a not for profit organisation who can give you free advice.

Thanks for your response. I don't think this is to do with the value of the flat - i've not mentioned it as a figure, as probate has only just been granted. We're 6 months off being able to realise this as a capital asset by selling it.

What they had written on my note - because a staff member at the Job Centre showed me - was the estate bank account plus the council direct payment fund (=£21k), plus my current and savings accounts (=£2k) and totalled it as £23k. That's what they are saying is my capital over £16k, and therefore have closed my claim.

I'm in SW london. I'd be hugely glad of some help. But in the meantime will write tomorrow and ask for mandatory review, sending by registered post.

Hi David

I don't have any support to do this and I'm very confused. Can you help?

I don't know which bit of which guide I should be following for this process - what I should mention, what I should include with the letter etc. I can't find anything about MR in the B&W ESA to UC guide, and I'm not sure whether I should follow the ESA or UC MR information, or something else.

I've got enough money to scrape through perhaps 3 weeks, but the UC payment was supposed to cover 2 weeks' overpayment of HB that was accidentally paid duringthe transfer process. I'm pretty stressed about this as you can imagine. No idea who to contact about what...

Grateful for any advice/signposting you can offer.
