PIP finally

This morning my stepson received his award for PIP. The decision maker decided he was not entitled to any mobility!!! He stated the reason being my stepson could walk 200 meters, despite him being bedridden and not being able to walk at all or even stand! He cant even mobilise his own wheelchair or get into it! At no point was this not explained (in great detail many times) on his PIP application.
Despite requiring 24/7 care, he was only awarded standard care!
My stepson should have had the maximum points for the descriptors and activities but instead, he was marked zero!
They stated in the award letter he could make his own meals and wash himself. This is not correct and it was explained on his PIP application form. This would be impossible as he is extremely ill.
All the medical evidence sent with his PIP application was disregarded as was the very detailed PIP application.They stated they realised his condition would never improve. but ignored how much care he requires. I understand I can ask for a reconsideration but is there anything else I can do as this is so very wrong.

I notice that you have previous PIP related queries in different topics which I will merge with this one for continuity.
This is very sad, but not at all uncommon unfortunately !!!

Even if he could use a wheel chair, manual or otherwise, PIP "Moving Around" Mobility Activity only assesses your ability to "Stand then Move" "Walk" the requisite distance !!!
e.g. Any claimant that had to use a wheelchair through necessity rather than by choice who could not "Stand then Move" "Walk" the requisite distance "Reliably" and "Safely" for "The Majority of Days" should be awarded Enhanced PIP Mobility.
If this Decision blatantly contradicts the real situation and the supporting evidence that you have provided, besides requesting an MR, you could also complain to your M.P. and ask them to assist in your complaint to The Assessment Provider and The DWP :
Contacting your MP
If the quality of The PIP Assessors report was particular poor, you could also complain about them personally, to the Regulatory Body for their profession.
e.g. The NMC if they were a Nurse/Midwife, : The GMC if they were a Doctor, etc, etc !!
Some generic advice on requesting an MR/Appeal :
You have one month from the date of the PIP Decision Notice letter to make a written request for a Mandatory Reconsideration (MR) of the PIP decision.

To request a copy of The PA4 PIP Medical Report compiled by the PIP Assessor at your face to face and sent to The DWP PIP DM to be used when the DM came to their decision.
If you have any problems obtaining The PA4 with a verbal request, you can make a written request which should be done as a separate issue to any MR request :

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.
Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your PIP.
Write DPA 1998 SAR in front, top, left corner of envelope.
Once received, they have 40 calendar days to comply.
You should not miss your one month deadline if The PA4 or any other supporting evidence that you may be awaiting has not arrived.
You can make comment that you have requested this and will submit further evidence if applicable when you receive it.
Once you have The PA4, you can then pose any counter arguments to the PIP Assessors recommendations.
e.g. If they are stating that you can carry out a particular PIP Activity, has it been taken into account that to be classed as being able to carry out a PIP Activity, you must be able to do so Reliably and Safely for The Majority of Days
If the Assessor has stated that they witnessed you Walking a set distance have they taken into account the above, the time it took you to do so, and any pain, discomfort and breathless, etc that you may have suffered whilst doing so ? etc, etc, etc !!
You should be aware that when you request an MR, any current PIP Awards, Daily Living and/or Mobility, that you might have, can be increased, reduced or taken away altogether, as they will look at the whole PIP Awards afresh.
Obviously if you have no current PIP Award, there is no risk involved.

Once you have gone through The MR Process, if you are still unsuccessful, you have one month from the date of The MR Decision Notice Letter to appeal directly to The Tribunal Service. (TS)
You should do this using one copy of The MR Notice letter (keep the othercopy) and the : SSCS 1 Form (Download Link)

You should concentrate on reiterating where and why you should have scored the extra points with respect to the applicable PIP Activities and the appropriate scoring PIP Descriptor for that Activity, whilst cross-referencing to any medical evidence that you have, or may have already provided which indicates that you should have.

My stepson finally had his award for PIP! What a nightmare its been. They chose to ignore everything in his PIP application. Decided to medical him at home, cancelled, then decided to make him travel for his assessment when it was stated on his PIP application this was not possible. Consultants reports,dietitian, occupational therapist and GP reports all ignored! A nurse at Capita, decided without seeing him that he could walk, cook a meal, wash and required no help with toilet needs! Despite him having muscle atrophy from being bedridden and him having to be lifted into a chair and wheeled to his disabled toilet! He is unable to talk but this was ignored also.
I requested a mandatory reconsideration. I typed out from this site, every PIP descriptor and what points my stepson was entitled to and not the 2 or 0 points like they had scored him. I had a letter from my MP. Their office rang PIP several times. My GP came out and did another report and finally they gave him his award! This has been a very stressful few months.
