Hi well I received my decision for PIP award this week ah! My DLA is higher rate mobility lower rate care my PIP award is standard for both. They claim I can walk 20 meters I sent them a photo of my injured face from I fall I had in my garden . They claim I can use gadgets for daily living I sent them a copy of my specialist Nurse report stating my fingers dislocate. Clearly I have to dispute this award even though I am terrified . How do I ask for a mandatory reconsideration? I sent a letter in July to the DWP stating the date of my assessment and I requested a copy of the assessor's report . In the next paragraph I requested yet again a copy of my DLA medical file . I rang the DWP yesterday to inform them I still had not received any of the information I requested . I recorded the telephone conversation where Angela the staff member I was speaking to said that I had never made a request for for my PIP assesssor's report and read my letter to me over the phone and she did not read out my first paragraph where I do request a copy of the assessor's report. Do I need to make a complaint about this incident ? Thank you once again for all your support I truly value you hard work . Fired up and ready to go ! sue

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Your DLA information, even if it is still available, will be in off site storage, you need to make a Subject Access Request for it.

Hi Gordon thank you . I do not have a copy of my assessor's report as DWP deny I asked for a copy even though they admit they received my letter so I have asked for it again verbally do I need to back this up in writing ? Do I say on my mandatory reconsideration letter that once I receive a copy of my assessors report I may use it as extra evidence ? Do I say the same about my DLA medical evidence? As far as my clinical depression goes they say the only input I have is a low does of seteraline . I submited written evidence that I had been referred to a clinical pyscologist . I now have an appointment on Wednesday . Should I say that I will submit a pyscologist report as extra evidence as soon as I have one . Thank you . Fired up and ready to go . sue ah! :(

You have two options, include a detailed set of reasons with the MR request or submit a basic MR and tell the DWP that you will provide additional information once the report arrives, but the DWP will only allow you an additional four weeks to do this and this includes postage time.

The critical thing is the one month deadline to submit the MR, you really don't wan to miss this.

You may be able to use the report when you receive it, but you do need to make sure that it is supportive of your claim.
