Hello.

We have a Tribunal in process though we haven’t had a date but we’ve just been notified that Stuart will have a 2nd PIP assessment in a couple of weeks. Can anyone tell me how this works? Cheers. xx

Is this in regard the Decision being appealed or is he being reassessed?

I think they’ve finally accepted that the previous assessment was unfit for purpose after my 2nd letter of complaint from what I could gather on the phone today. The advisor was very cagey but she said it was because of my complaint.

Sorry Gordon, yes I think it’s the decision being appealed. I’m quite angry that they appear to get a do-over after lying and under reporting his condition in the last assessment report. I’ve also asked them to make sure that the person sent will agree to be recorded. I was assured that wouldn’t be a problem.

I’m surprised to learn that they don’t employ Drs for assessments! It’s a very rare and complex condition that really needs specialist input for them to understand.

In that case, I assume that there will be a new Decision made, this may be the same, less or more. If more than the current Decision then the appeal will be lapsed (cancelled) but he will have a new right of appeal if you are still unhappy.

Thank you Gordon. I’m going to press on with the reply to DWP Tribunal submission and just see how that goes. We’ll deal with the 2nd assessment when it comes round. Be nice if claimants got a 2nd chance if they fluff their assessment interview wouldn’t it?

It is atrocious though. She said he walked slowly and had to push on the table to get up but the detail in her MSO said he could do a squat. Total fabrication!
