42,000 claimants lost their PIP award in 2021 because they allegedly failed to return their AR1 PIP review form, the DWP revealed this week. This is an unexplained increase of almost 300% in just two years. 

Tom Pursglove, DWP minister for disabled people, published the figures in response to a written parliamentary question.

The figures show the number of claims disallowed each year for non-return of the AR1 review form:

  • 7,500 claims were disallowed in 2017
  • 15,800 claims were disallowed in 2018
  • 14,100 claims were disallowed in 2019
  • 25,400 claims were disallowed in 2020
  • 42,100 claims were disallowed in 2021

It is not made clear from the written answer whether non-return includes forms that were returned late.  It is also not clear how many people challenged the decision that they had failed to return their form on time.

At Benefits and Work our concern is that the number of claimants allegedly failing to return their forms seems to be increasing at an extraordinary rate, far outstripping any rises in awards that had taken place at the time.

We know that the DWP’s post handling and call management is dire and getting ever worse. It seems very possible that many disallowed claimants are returning their forms on time, but the DWP is either losing them or taking far too long before recording that they have been received.

We have no way of knowing how many of the 42,000 claimants appealed or how many simply gave up in despair, even though they knew they had returned their form on time.

Other claimants may have failed to return the review form because of the effects of a physical or mental health condition.

A tragic example of this is the case of Laura Winham, who we wrote about just last month.

Laura had schizophrenia and had been sectioned under the Mental Health Act in the past. 

In 2016, the DWP contacted Laura to say that she was being transferred from DLA to PIP and that she had to apply for PIP or her DLA would stop.

Laura failed to respond and, after several written reminders, her DLA was stopped.  In spite of Laura having a severe mental illness and very clearly being a vulnerable person, no attempt was made by the DWP to check on her wellbeing or her ability to take part in the transfer process before her money was cut off.

In May 2021, Laura’s body was discovered after her family visited to tell her of the death of her father and looked through the letterbox.  The police found her mummified and skeletal body when they forced entry.  There were unopened bills from creditors and markings on the calendar which stopped in November 2017.

One of the last ones read “I need help”.

Yet in the same written answer which revealed the number of claimants whose PIP had been stopped, the minister claimed that vulnerable claimants do not have their claim stopped for failure to return their form.

According to Pursglove, claimants with serious mental health or cognitive conditions who have difficulty communicating or engaging with the process, have their files ‘watermarked’ as Additional Support (AS), although they are not classed as vulnerable.  These claimants will be asked to attend a PIP assessment even if they fail to return their form.

Claimants who are identified as vulnerable due to their condition or their circumstances have an Additional Customer Support (ACS) watermark placed on their files.  Some claimants have both. These claimants are “afforded additional sensitivity and protection at all stages of their claim, not just at the point of disallowance for failing to return a claim form.”

We will be updatng our PIP claims and reviews guide to make readers, and support workers, aware that they may be entitled to this ‘extra sensitivity’ if they do find themselves in difficulty.  There is no reason why claimants should not make a data protection request for details of any AS or ACS watermark on their files.

    Send by certificate of post and email confirmation of been sent . I expect 2 yrs for a review and 2 yrs for a tribute hearing thus many lives lost linked to people not able to live life independently safely. I cause fires linked to memory attention problems and live in a high rise block of flats that has no fire resistance between floors/ ceilings government does not care hoping for lose of life

    My review forms were posted to me and dated 12th December 2022. I received them on January 5th 2023. I called them straight away and said that I’d received the review forms and that they wanted them back on January 14th which was impossible. So the call handler said ‘ it’s ok it’s been extended on the system, until February 11th .’ 
    So, I filled my form in and posted it back on January 31st, recorded delivery by Royal Mail. It was received on 1st Feb and signed for . It was put on the system on the 2nd Feb. I called on Friday 3rd Feb  and they said it had been received etc. 
    The post arrived that day and I received a letter stating my PIP was stopping the next day because I hadn’t sent my forms back on time. So I called straight away, took over an hour to get to speak to someone and that lady was so rude. I told her what had happened and she said ‘ I’ll try to get a case manager to look at it. It must of crossed in the post” . 
    So I said ‘it didn’t cross in the post because I had until the 11th of  Feb to get it back to you.’ 
    She said ‘ well I don’t know what you expect me to do. A case manager will call you today or tomorrow. 
    So I said ‘bye’ and hung up . I was absolutely fuming. 
    On Monday 6th Feb I called back. A lovely guy answered my call and I’m so grateful he did. I explained to him what was happening and added my pay date was actually that week. So he said that he’d put me on hold and would read through it all then come back. So he said “ I’m going to speak to a case worker whilst you’re on hold, then I’ll get her to speak with you. 
    A few minutes passed and the next thing a case manager called Louise spoke with me. She couldn’t apologise enough for the stress and anxiety they had caused to me. It wasn’t my fault at all, it was their system and them to blame completely . So she would get it all sorted and notify those that needed notifying. Pay day is tomorrow so I really hope it’s all sorted. Louise did say that I’m looking at September/October for the  review outcome, as they’re 8ffr4n4d months behind due to Covid.

      Chase this either with a stiff letter posted First Class Signed For or a phone call you note when and who you spoke with and what was said. Keep a copy of letters sent and check via Royal Mail Tracking when this was signed for. Keep doing this every six weeks or so. Remind them they have time limits on their service. Send copy of letter to MP. Worked for me.

    I am a claimant and a voluntary benefits adviser, unfortunately able to do less and less these days, but I have dealt with the DWP alot over the years, and although I have occasionally had a few great experiences with them (I don't like tarring them all with the same brush), I know for a fact that they either lose mail conveniently or just don't look for it, because when I ring them to tell them I sent stuff back and they should have received it on a certain date, they tell me they haven't had it (this has happened on numerous occasions). I then tell them I sent it Special Delivery, and they suddenly find it, it happens every time. So I always send government stuff Special Delivery, if my client can't afford it, which is most of the time, I pay for it myself. And I recommend it to my clients with every form sent back, especially if it has a set return date.

      Our company would have been bankrupt ! 

      My own experiences with this lot over the years can’t be co-incidental - as proven - must be hundred of thousands of claimants chasing their tails

      @Gail I do the same when I have to send anything to DWP I send it special, recorded or registered. It’s not that expensive and they can’t deny they haven’t received it.

    As previously written in another thread. They are losing peoples forms in the Wolverhampton PO Box.  The head decision maker told me that our forms go to a PO Box in Wolverhampton. They get collected and the info uploaded to their data base,  then they get sent to the Decision makers. But somewhere between these systems forms were getting lost , delayed etc. He admitted one guys form didn’t show for 40 days and mine took 38 days. I found if we ring the PIP team and keep on top of the phone calls to say you sent it. Do recorded delivery. Or take a photo of you posting with time and date evident. I wait a couple of weeks to check if they have it. Then they know I’ve posted it ( remember the date) also if you get your form always check the date you recieve the form as they post them second class ( mine took 12 days to get to me) they don’t include) that in the month but law they should as you get a month to complete it. If I need help. I phone ask for an extension to that time to get the full legal month. They give it. If you have to wait for a support workers help and to get an appointment for it. You can ask for an extension if you ask, tell them the date and ask them to allow for posting ( and if there’s strikes mention it too) they have always been reasonable with me in this regard. So please do it. GL

    I completed mine and returned in Jan 2021. Only just had the assessment this week! And that only happened because DWP made an error and to apologise to me they moved my case over to review sooner. I'd still be waiting now and it's over a year.

      @John Roberts You need to chase this. Strongly worded letter sent First Class Signed For - AND check when it is delivered and keep a record of that. Don't give up, BUT you MUST make them take notice. You should have heard something by now.

    I had my pip review just before Christmas 2022 I explained to DWP concerned could not back due to postal strikes and bank holidays they said we’ll make sure. you get it to us as it will stop I did get it back but had to supporting info later

    I'm going through this now im waiting to go to a tribunal last year they said they lost mine I'd sent it recorded delivery I put a complaint in they soon found it with a few days they are shocking always recorded delivery your letters to them

    This is interesting as this could have happened to me. I got my PIP renewal form 3 weeks after the date on the letter. I still had time to complete it but couldn’t face dealing with it so I telephoned and was told that they would extend the date to return it to 23 Feb. They said I may get a reminder letter through the door regarding the earlier date but just to ignore it. Anyway I do get a reminder letter but as I don’t trust them one but I called back. Turns out my date was extended but only til 9 Feb. Had I not called I would have assumed that I had until 23 Feb. They did then extend it to the 23 Feb. I sent my form 1st Class recorded delivery and on 30 January, just in case they had kept the date at the original date. I kept my receipt and checked it was signed for. Within a couple of days I got a text message to say they had received my form blah blah blah. DONT TRUST A WORD THEY SAY.

      @SJP I received a form on 10 Oct stating they have not yet made a decision, can take up to 8 weeks etc. Then on 14 Oct, the money went into the bank £1788, today is 24, still no letter. Does that mean I will receive more PIP or could they take it back and say it was a mistake? Worried.

      @SJP That's really helpful, thank you. I'm awaiting mine ( well sometime in the next 6 mths ) and due to the RM issues ( and the possibility of more ) did expect it might still get delayed 

      I would have just asked for an extension, as I've done before and take it at face value it would be fine ( 2 wks on request was always the norm plus possibly another 2 in extremis )

      I also help on another forum and we've had a few similar cases and have just been telling them to do the same. Might just have to start telling them to do it and DOUBLE CHECK afterwards now !

    I had a Review Form arrive in February 2022 when I had Covid. All in all I had two extensions due to not recovering as well as hoped, which was partly due to one of my health problems. Each time I rang before 9am, pointedly asked the name of the DWP employee who answered the call and made a note of the date and time the extension period was granted. I photocopied the final version of the form and sent it by First Class Signed For post NOT in the pre-paid envelope. I then kept an eye on the Royal Mail tracker until I had a date and time that the envelope was signed for, and made a note of this on the Royal Mail receipt, which I kept in a safe place.
    I didn't contact the DWP for at least 12 weeks. Then, roughly every four to six weeks I rang to find out progress making a note of the person I spoke to, the date of the call and what I was told.
    Eventually, when it got to late October with no apparent progress, I sent two letters by First Class Signed For post to A) the DWP making a strongly worded complaint, and B) my MP asking him to chase my Review Form Progress.
    I have still had no response from my MP, but within three weeks or so of my complaint being signed for, I received a call from a senior manager at the DWP and my PIP was renewed by a considerable time.
    Keep records; note dates, names and content of calls; chase and don't give up. Use the Citizen's Advice Bureau for help.

    How ironic as this happened to me just recently. 
    I called for an extension, it was granted for two weeks.  Forms completed and posted from the main regional sorting office.  Unfortunately I never got proof of posting. 
    3 days after the deadline date, I called that awful appalling number again,  to report I had not received confirmation text they had received the forms.  Spoke to a chap called Michael, who said due to postal strikes and backlog of post there was no sign of my forms, however he would make a note on the system ( my account) they had been returned and keep an eye out for them.   I stressed I had copies so could just send in copies,  a number of times, but he insisted there was no need, he’ll get in touch with me if they don’t appear.  
    Like a mug, idiot whatever I believed him. 
    Next I knew,  a call from ESA to say my PIp had been stopped due to non return of forms and therefore my ESA was stopped. 

    Next comes the farce of contacting Pip again,   Chap called Muhammond was adamant no record of my previous call, no notes on my account, no incoming call log from my number.  Parrot fashion ge kept repeating I send copies in, it will go to a case manager and 99% gets reinstated. 
    So in the meantime I’ll be in limbo . 
    So I stated I’m instigating a formal complaint, I’m not happy at all and I want to speak to someone higher. 
    Put onto a case manager,  explained the circumstances, dates n times and that I had screenshots of my calls to the dept too.   She had no explanation as to why Michael had not made notes when I called, nor why there was no record of my incoming call ! Nor why this call handler rejected my offer to send copies initially ! 
    She then reinstated my claim, and authorised PIP payment to continue. 
    I posted copies the next day, special Guaranteed delivery , with a stinging covering letter. 
    I then phoned ESA, every call to either is frustrating, time consuming and energy draining. 
    Lady at ESA investigated, saw PIP was reinstated and therefore reopened ESA. 
    Strangely she completed a SDP form over the phone ? When questioned why as it was all set up she said it’s what they have too do. 
    So there’s me thinking it’s all back on track - how wrong was I ! 
    Text arrives 3 days later they are paying 198 sdp into my account arrears owed ? 

    No esa went into account on due date so another call !  Chap says that’s the arrears we owe from stop of pip to claim being reinstated - errrrr no says I,  apart from the sums don’t add up - I’m not owed any arrears-  I initially owed you when you stopped my money as I had already had two weeks money paid to me.  
    I’m not owed any arrears and I don’t owe you owt ! 
    Oh yes he says, went off to investigate and responds that I’m right, they’ve stopped the 198 going into the bank and your next payment will be paid in due date as normal -of course yesterday it was not 😳
    Pup blaming systems errors 
    ESA blaming system errors 
    Next due Pip payment did not go into the bank - they had said 3 to 5 working days. 
    Another call,   System had reclaimed the payment in error ?   
    Same day payment authorised a week late - ps, todays payment paid as due for pip 
    Then I’m told a letter being sent that my pip claim has an end date of x July 2023 and I will have to make a new claim again! 
    What ? My award was until x June 2023 and hence why the farce about missing review forms ?  Why it how can I make a new claim when I’ve an ongoing claim ? How can I claim for the future before this claim supposedly expired?  That’s fraud ! 
    Oh yes she says,   Off to speak to someone else ,   Returns I tell me they’ve no idea why the generation of end of claim and incorrect dates!  Ignore that letter that’s in the post,  and things continue as normal whilst my review is being processed - in the log jam then , 
    Yesterday no ESA again, another hours wait to speak to someone, tedious annoying upsetting and fraught - we do not need this ! 
    And the reason this time - the system had authorised my payment but not sent it because the PIp system is updating the increases for April !!!! 
    You could not make any of this up, script writers on EastEnders and Corrie couldn’t dream it up - a system that’s broken, not fit for purpose. I would even go so far to say staff deliberately misguiding callers, not recording calls and all manners of underhand tactics to cease payments.

    I returned my review papers in good time by Special delivery so fully tracked. I had a signature on receipt and kept this in case of issues. After a few weeks I ring and ask when I can expect a decision. They deny receipt of form. I have 2 days to go to the deadline.

    So, I contact my good constituency MP and send him proof of delivery. He’s on the case. I contact Royal Mail and speak to someone who agrees to see what’s happened. She says they delivered; I have the proof but will see what else she can find out. She later rings me on the latest date to return forms and says it’s popped up on tracking some distance from DWP, the opened envelope seems to have been put straight in the outgoing post and she has someone collecting the envelope and contents and hand delivering to DWP by the end of the day. She sends me the new signature as proof of delivery later that morning and copies to my MP. At least, I think, it's just in time.

    I then get a letter from DWP saying I didn’t return my forms at all so case closed. Back to my MP, who is now only slightly less cross than me. I write a formal complaint to DWP and ask for a review and explanation why an opened envelope with sensitive information was put in an outgoing mail sack and not even logged as received. My claim seems to be reinstated but no letter. MP gets a reply, claim reinstated ‘as a gesture of goodwill because RM lost my forms’! That’s a lie for a start.

    A couple of weeks later I get an appointment for a phone assessment. The woman was clearly working from home, I could hear her kids in the background, the TV was on, the dog was barking and her partner asked if she was going to be long and did she want a cup of tea! I said (as apparently these are all recorded) this was all inappropriate and I was supposed to be offered confidentiality. She didn’t respond. 2 hours of questioning and she finally hangs up. I am exhausted by it all. I have just relaxed when the phone rings, more questions for another 15 minutes. By now I am in tears (and I don’t cry easily). I’ve had enough. No doubt I have another appeal to go to, I’ve done so many in the 8 years I’ve been claiming that they no longer scare me. Fortunately, for once, the first time, I am believed and my PIP continues. But the entire system is inadequate, corrupt, full of lies and not fit for purpose. It needs an independent review of fitness.  The assessors, when I have managed to find out their qualifications, are not qualified for the job. I've had a hospital administrator and a 3 month trainee nurse, and suspect some of the others have never been near a medical establishment.

      @Sue Make a complaint, if you think you can bear to, with the help of CAB through your MP. Ask for a Decision Maker to read the complaint.
      You are right about staff being unqualified to interview - mine told a load of lies from start to end and totally ignored things she was told or saw as it was Face-to-Face. I tore her 'report' apart line by line, paragraph by paragraph in reply. That is the only way things will change.

    I always use a welfare officer to fill in my forms or check and sign them , also copy the forms and return recorded delivery so they have to be signed for - this way will ensure DWP has received them , hope this helps . I did my last form earlier this year and was awarded ongoing PIP for at least 10 years so it’s worth taking the extra trouble .

    My daughter suffers from mental illness  found the form too difficult to complete. I filled it in with her but she didn't know what to say for the telephone call and they didn't award it to her. She has a personality disorder and ADHD and finds daily living a challenge.

      @Noon I am aware that ADHD and other 'invisible' conditions are often ignore because the person who works for Capita has not idea of the conditions they are collecting data about. They would be perfect Quality Surveyors in a factory where everything is the same model, size, colour etc but we are humans and every one of us is unique. It is time that the staff collecting criteria were only chosen from departments that were working with people of that ilk ie Have staff who know about MH assessing on those with MH. Physical ailments should be dealt with people from that arena ie Occ Therapists, Physios etc. At the moment it is like asking Al Bundy who sells shoes to sort out a Percheron that needs new shoes. Crazy, no rhyme or reason.

      @Noon Ask for help from staff at the local Citizen's Advice Bureau and any mental care staff who help her. They are used to what to write and know your daughter.  Keep copies of everything and send any replies by First Class Signed For post - DO NOT RELY ON USING THE PIP PRE-PAID ENVELOPE.

    my renewal form came in dec 2021 to be back by 29th dec. I (foolishly ) let my social worker complete the form as every time i am due for renewal or to a new benefit, they cause problems. I actually got it to an upper tier tribunal in 2015 and was given the go ahead from ICE to go to the ombudsman via my MP.  They advised me to take it legal (which I still have to do) I also received a letter of apology from dwp plus £100 ex gratia payment. I am still waiting to hear and had a text to say my claim had been passed to an agency for assessment despite no change being put on form. It is scaring the life out of me as I cant manage without my pip (and my car). Asa former employee of dwp I am disgusted they can treat people like this.

    I have just received pip. 1043 review form last week on 06/02/2023 which was totally unexpected, because have letter from 11/01/2021 which states "Your pip award has been extended until 29 June 2024"
    So why I have received review form some 16 months before my current award is due to end seems very unusual to say the least.

      @Edwin My PIP is/was running until November 2023, but like Denise above, the renewal/review form arrived just before Xmas with only 2 weeks to get it back.  So I filled it in and sent it back by Special Delivery so I had photo proof of signature at DWP receiving it - you cannot trust them otherwise. Five weeks later, no acknowledgement of receipt from them, so do I phone and wait for an hour again to be answered?  Apparently it can take several months to get a decision from them due to 'backlogs'.
      Why are they sending out review forms many months before current award expires?  Only they will know how to answer that. 
      Maybe it is an edict from the top to get ahead of renewals expiring due to the number of weeks they are taking to process renewals. 
      However, cutting off benefits when an existing award still has months to run due to them losing the returned review forms seems very sharp practice.

    This is exactly what has just happened to me!!!! I got my review form through with 11 months still to run on my award. it had taken so long to get to me that I only had 10 days to fill it in and return it so I phoned and asked for an extension. the lovely lady who I spoke to arrange this agreed to do, as it was over Christmas and new year I struggled to get an appointment with a benefits advisor. 
    As he was then ill I phoned again to ask for a few more days and was told that my date had been automatically extended to 4 February. I filled in my form using your guides very carefully as I have done before as I couldn't get the appointment rebooked in time to return it. This took me a long time as I have an ABI and CFS/Fybromyalgia.
    I posted my form back in the morning of 27th January at the main post office in town upgrading the postage to first class. I got both proof of postage and also took a photo of the envelope on her side of the counter including her name badge but not her face. it was due back by 4 February. i received a text saying it had been received and was in the system on 7th February. 
    I am so glad I did both of these things as last Friday I got a letter saying that my claim was stopped as I had failed to return my form in time and that i had to hand back my motability car which I had only had two weeks due to the long wait for its replacement. As my mental health had really suffered due the stress of putting down in writing my everyday struggles this was the final straw.  I had a complete meltdown as I would now lose the money to pay those that help me, my car which gives me independence and my husband's carers allowance.
    I have followed this up with a letter with copies of the proof of postage and photos to prove it again with proof of postage and a photo her side of the desk and I'm now waiting to see what happens next.....

      @Wendy Hazelden Wendy - as difficult as it is, you must phone them, no matter how long you are on hold, and ask to speak to a case manager,  tell the call handler you are making a formal complaint.  
      Stick to you’re guns, don’t let them fob you off.     Tell them you have photographic evidence and ask them to reinstate your claim.   
      It can be done - but you must call

      @Wendy Hazelden Hi Wendy. I’ve just posted what I’ve done. Might be worth trying to contact them. My story is pretty similar to yours. All my other benefits will be messed up to. It had only been one day and housing benefit called me asking how/when I’ll make my rent payments. So then have to explain everything over and over again. Good luck.

    I am 100% right and feel the same , the assessors are (how I hate to say it) are liars .
    When I went for my assessment he apparently put I could walk 200 yards, the room I was in was 10x12 he never even asked me to walk. I was also told that I wasn’t the normal pip person and that I should walk in on all fours . I was very upset . I’ve worked all my life , and now I need help . The people that should assess you should be your dr or hospital that u are with . It’s extremely distressing.
