In the last month, Benefits and Work has heard from four members who have received a backdated payment of PIP because of errors relating to the “Engaging with other people face to face” activity.  Payments have ranged from £5,000 to £12,000.

The DWP say they are looking at 326,000 cases where they may have got the law wrong.  However, they are moving extremely slowly and there may be many more cases which they have failed to identify.

But some of our members have had their awards looked at and found to be eligible for a lump sum payment:

“Had a call on Tuesday this week (5th) from a decision maker, she ran through a few questions with me, like how I prepared if I am going to go out and who I use as my support when I do that etc. She told me there and then that she was going to back date my claim to 2016 and increase it from standard to enhanced. I have just had just under £5K paid into my account today.”

“Got a phone call I’ve been awarded almost 10,000. This is from 2017 to 2023. I was moved over to ADP last year. My payment has gone up to enhanced also from standard.”

“My partner received a missed call Tuesday, text received stating they will call back Wednesday morning. It sent him in a whirlwind thinking they were going to stop his entitlement. The lady called as previously stated, spoke about the situation in hand and advised he would be receiving a payment in the coming days for almost £12,000. It has definitely come as a shock to say the least. I can confirm we hadn't made any contact with PIP (Dwp) in regards of this, they just contacted us.”

Other readers have left comments highlighting how slow the process is and how hard it is to get any kind of response from the DWP.

“i sent of a letter a month ago signed for heard nothing so i phoned them and they agreed they had it but no one had looked at it ? so i asked what now and he said someone will look at it and i said when he said i dont know??”

However, we do know that Midnight above, originally contacted the DWP in October last year asking for them to look at his case and finally had a text from the DWP in December saying they would deal with it by 11 February 2024.

In fact, it wasn’t until 5 March that Midnight got a call from a decision maker who asked a few questions and then made an immediate decision over the phone about back pay and an increase in their current award.

So, awards are being given to some people who contact the DWP, as well as those who just wait and are contacted out of the blue.

According to the DWP more than one five claimants who have been reviewed have received an award. 

We suspect that the rules are being applied as restrictively as the DWP can possibly manage. Nonetheless, if you think you are entitled to back pay then the situation is far from hopeless, whether you choose to contact the DWP or wait and hope that you will hear from them.

    I received the call on Wednesday the 10th of July , the woman said she will issue the payment the next day and it will take 5 days. Does anyone know if it lands quicker than that?

    Hi l received my pip renewal and was successful and have moved to enhanced on both.
    But they haven't back dated it renewal forms sent back.
    2022
    Review in June 2024
    Only back dated June to July 2024
    Just checking if anyone knows this to be correct.
    Also l dont drive can l claim car tax reduction on husbands car tax.

    I was contacted via letter from DWP re new l2016 law I filled form in and sent it off I decided to call to make sure after a week they had received letter

    Lady helped me also do form over phone 

    She said it was quicker than waiting for letter of appeal to be dealt with

    They were very helpful and she said I wud be notified by a decision maker on outcome up to two weeks 

    I requested decision maker to phn me with outcome which you can do 

    2 days latter I received a tel call saying I had backpay of £6900 

    I wud advise everyone  to do form over phn and request they tel u with decision rather than a letter

    You will get letter too but I can guarantee its quicker this way money in bank at midnight today 

    If you were on lower rate with 10 or 11  points you can should be pleasantly surprised if you had someone help you with social situations includes friends relatives

    How do I know ism entitled to a  backdated payment I was on lower rate care dla and high  rate mobility dla wen I changed to pip I had low rate mobility and high rate care ... don't understand how they could change it

    So received a letter stating that the law change and they looked at my claim and I’m not due anything, I applied for a mandatory reconsideration in January 2024, I had a call yesterday saying they looked in to this and have been awarded pip from 2016 till 2019 as 2019 is when they accepted my claim

      @Ben When did your claim start if you don’t mind me asking?i called up and they was still sorting out the year 2016s claims and I started my claim back in 2017 and they said my claim had been flagged and they will get around to it they do it in years apparently starting from 2016..

    Hi,

    I had a serious car accident in February 2022 - I was ploughed into at 50mph from behind whilst stationery, I lost my job because of it and haven't been able to work since due to severe whiplash. I had fully comp insurance yet I still haven't had compensation. 

    I never knew I may be able to claim PIP, does anybody know if it is possible to claim and get it backdated?

    Any input would be most appreciated as I have no savings left and may lose my house.

    I put claims in for pip since like 2008 but only got awarded pip in 2019 and courts  but I was putting claims in for years and got rejected would I count for this but only from 2016 and what do I do if so

      @Sonia I'm afraid that you will only receive if they do decide to back date to 2019 I would contact the C.A.B or other places like your housing support there is other groups that can help with this matter

    Has anyone that got their award through the appeals process got a backdated payment, ie I do qualify for the leap award but because my decision was made by the tribunal I somehow do not qualify.

    I do know one person who has had the backdated payment who got his award on appeal but only have that one reference.

    Any input is welcome.

      @Citizen I had to go to the tribunal about my PIP it took me awhile to receive it and but only got just over half of my reward back dated I did ask about the rest of it but I git no reply I phoned and wrote but no reply from that not even when c.a.b wrote to them

    hi ive been on pip for about 3 years now due to having 2 lots of cancer, my question is i get my pip money every 4th tuesday, but im always borrowing after the 2nd week does any body know if pip would pay me every 2 weeks instead of every 4 weeks ??

      @TERRY PAGE I'm sorry to hear your problem but PIP will only pay every 4weeks if your on benefits aswell  and struggling contact the c.a.b or housing support group there is a few that can help sort this problem out for you

    Can anyone help me iv had mental health for a very long time also glaucoma and  artists I am on enence pip but only for the last 4 years befor that low but nothing has changed in meny years apart from the pain is alot worse. I sent in my review befor Christmas I got a tex on my phone saying they still have my pip form and will be progressing my review as soon as they can I still may need a assessment with a health professional. But I'm already under the mental health team and my mental health doctor my doctor physiotherapist and occupational therapist so I don't understand. And now I'm getting bold spots because I'm stress about having to go out I no I have someone with me most of the time anyway but panicking about just going out sorry it's long thankyou all.

    Would this apply to me? I applied for PIP 3 times previously to receiving my first award in 2020, and I was rejected although I was regularly seeing mental health professionals for trauma/EUPD/anxiety

    I was awarded 3 different  awards with different amounts of points signed by the same person all with the same explanation on each 1 for high rate 2 for middle rate my claim got cancelled but my partner does everything as I can't socialise and have severe breakdowns . How do I check a claim that's been closed ?
