Hi Everyone,
Unsure if I should start a new topic, or rename this one somehow, or just leave as is...sorry if I'm doing the wrong thing.
Anyway, having just breathed a huge sigh of relief over the successful PIP claim, what should drop through the letterbox today? Yep, a letter and form for me to fill our for renewal of ESA.
I just cried and cried. Why don't they just leave us alone for a while? It's so awful, and causes so much stress and upset to those of us with MH issues.
The only thing that made me 'man up' and stand strong was having read other peoples' stories on here, and knowing that we are all in the same boat, and all here for each other.
I'm off to study the ESA guides, wish me luck!

It is explained in the guide
There are two Exceptional Circumstances Regulations; 29 for the WRAG and 35 for the Support Group. They are a catch all for claimants who do not meet any of the ESA Descriptors but still have significant issues. Basically they look at the risk of harm to the claimant (or someone else) if the they are found Fit for Work (29) or able to perform Work Related Activity (35).
The main thing to be aware of is that they operate differently from the normal Descriptors in that the claimant must provide up to date evidence that they meet the requirements, just because a claimant met the criteria in the past does not mean that will be considered as meeting it now.

Last time I claimed ESA I had to go to Tribunal to be put into SG (although never got to Tribunal, the judge rang me and said they'd found in my favour without even seeing me). On the Decision Notice it says Regulation 35 was satisfied, so I just wondered what that meant.
Thank you for telling me I'll need up to date evidence.
