Replied by Chris on topic PIP Assessment Report before Decision
Gordon,

This message is for general information about the progress on this thread.

I called the DWP today to enquire about the outcome following my PIP face-to-face assessment. It has been approximately 12 weeks and I haven't heard yet.

The object of this thread was about my concerns with the assessment report copy I obtained, and how to formulate a letter to the decision maker to express my concerns before they make a decision (with the hope to avoid a mandatory reconsideration).

The DWP informed me today that it can take 19 weeks to obtain the results following medical for a re-assessment. That assumes they receive the report from the asessment provide within a week. In my case it took over 2 weeks for the DWP to receive so I can expect the outcome at 20 weeks.

That is a big surprise to me, as that isconsiderable more than the 6 weeks I was working with, but I'm informed that's for new applications only.

I sent my original application in June 2018, hence so far the review process has taken 7 months and possibility 2 more months. That would be 9 months total for a re-assessment. Whoua! Is this becoming normal?

Hmm. The psychological impact of such a wait is not supporting the thousands like myself with serious mental conditions, to say the least.

On the plus side, the payments continue during that phase, fortunately, but they may be stopped anytime once the decision comes through.

Fortitude, please come to my help and all my fellow claimers.

Chris

When my wife approached our GP early on in her PIP journey, he point blank refused to help. Our practice apparently has a policy of not providing evidence relating to 'benefits claims' when requested by patients. My wife suggested a private consultation, but that was rebuffed.
All GP surgeries will be different.
I wonder if there are any Private Occupational Therapists who could supply these type of reports. Having got this far in our journey, and having had professional dealings with the OT profession when I worked, I strongly believe that they could potentially be a tremendous resource if harnessed correctly.

Gordon,

I have a query about the MR process and would be grateful for some clarification. Thank you.

In the guide 'PIP mandatory reconsideration and appeal submissions', in the sample letter for MR request, under 'I wish to add evidence', here' s my query:

It seems that there are 2 types of evidence I could provide, 1) addtional medical evidence e.g. more detailed letter from GP and 2) submissions as per the sample submissions provided with the guide (7-step framework).

The sample submissions seem to be for an actual appeal (SSCS1), so I wondered if that information can be sent as evidence for the MR, or is it overdoing it? The actual sample MR letter seems to suggest it'd be OK to add such information.

In effect, I would be sending evidence with my MR letter, as detailed as I would as part of an appeal. Am I interprating the guide correctly?

Many thanks
Chris

Don't worry the type of evidence you are providing or whether it should be used for an MR or an appeal, just explain why you think that you meet the PIP Descriptors to receive an and why you think the information in the assessment report is incorrect, for the latter try and stick to issues that lead to you scoring points and if you have to tackle the assessor's opinions then do by reference to your evidence to show that cannot be substantiated.

Gordon,

I called the DWP today and was informed that my claim scored zero points, despite scoring 12 points for each 2 years ago, and my conditions getting worse.

I am looking to start the Mandatory Reconsideration process, I already have new and detailed evidence from my GP and specialist, but I now need to explain why I think I meet the descriptors and why the information in the report is incorrect.

The DWP advisor was very helpful and sympathetic, he told me that he sees so many cases like that on a daily basis. And the way forward, is the Mandatory Reconsideration.

The money has stopped, despite the fact that my previous award was guaranteed until end of May 2019. Do you know if this Is normal?

Thank you
Chris

Gordon,
I posted a message earlier, but I have an additional query here. Thank you.

I am about to request MR following an award of zero points by the decision maker. My GP and Consultant have prepared more details letters, that I would like to include with my MR.
1) Can I use the new evidence to show that the assessor's opinions are incorrect?
2) Can I use the new evidence to show why I meet the descriptors?
3) I would be interested to receive 1-to-1 individual help for my case, is the service available through B&W? If not, do you know who I may be able to contact to organise that at short notice?
Thank you.
Chris
