Hi Chris
I'm sorry regarding the results of your PIP assessment.

Yes it is correct, if you are no longer eligible for PIP then payments will stop. Remember also that PIP is paid monthly in arrears

your question regarding new evidence to support your arguments and dispute the decision is yes.
When you have established your arguments and identified which activity/descriptor you would like to challenge ask the Health Care Provider you approach if they feel comfortable in writing the letter specifically pointing out your arguments.
Sometimes a GP initially will write a generic letter, but if he/she knows you well then they may be prepared to do a more detailed letter

I am afraid B&W cannot do one to one work but try your local CAB, they usually don't take on form filling but may help with MR and appeals.

Sue,

Thank you for your reponse.

Both my GP and specialist have specifically focused their letter on the relevant activities and descriptor, so I think my medical evidence is now much stronger than it was.

With regards to the qualifications of the assessor, I was seen by a paramedics, yet one of my 2 conditions is a complex sound disorder. Now a paramedic is primarily trained to deal with physical injuries, so have no expertise in audiology, neurology and mental health. So would this be a pertinent argument to add when demonstrating that the assessor's assessment is not fit for purpose? To your knowledge, is there a court case perhaps where a judge might have stated that fact?
Many thanks
Chris

Chris

You cannot assume that the assessor was not able to properly assess your hearing, etc. problems just because they are a paramedic, they will have received training on all of the PIP activities, however, you may be able to show that they don't from their comments in the assessment report.

You need to make sure you understand the criteria that you were assessed against, you may be right that they have not assessed your limitations properly but if those limitations are not relevant to the criteria then you will still not score.

Hi Chris,

Sorry to hear about your PIP, I was in a very similar position a while ago.

I referenced the following ESA case as part of my PIP appeal submission. Not sure if it actually made any difference but my appeal was successful.

administrativeappeals.decisions.tribunal...px/view.aspx?id=3830

MR and then a potentially long wait for Tribunal can be very stressful but it really is worth persevering so that DWP wrongs can hopefully be righted.

Good luck.
