UC carers element was created by Perdita
Please can I check whether a carer can receive both the carer's element of UC and Carers Allowance. I mean if claiming UC and filling in the carer info on the form for the carer's element, should the carer be submitting a Carers Allowance claim form too?

Under UC the Carer does not have to claim CA for the Carers Element to be payable, as long as they can show that they are providing a minimum of 35 hours of care a week then the Carers Element should be payable.

However, if there is debate about whether the 35 hours is being provided then a successful claim for CA will solve this. Any CA that is paid will be deducted from the carers UC claim, so they need to be careful with any backdating of the CA claim as it can result in an overpayment.

How do they show they are providing 35 hours for the UC Carers Element? Do they have to provide evidence in he form of a doctor's letter?

It is not usually a problem they simply attest to the fact, it is usually only an issue if there are factors that argue against the carer being able to provide the time, for example; they are working or in education.

Thank you, so would the norm be to apply just for the UC with carers element in the first instance, then see if the carers element is allowed? (The carer would not be a fulll-time student or employed)

Yes, they need to make the DWP aware of the caring as soon as they make the UC claim or start the caring if the UC is already in payment.
