Hi LL26,

Thank you for your imput. I don't know or can't remember if there is some specific information on this particular subject in the members guides.

If not it would be really helpful if something could be included.

Then again, no-one seems to have a direct translation of the 'L' word.

Perhaps another forum member can come up with something as I am really struggling.

........The best I can think of for the moment is something like:

"...the assessor misreported that I was supposed to have stated I can walk more than 20 metres. However, the truth is that I clearly said that I can only walk a few metres and am in constant pain when doing so.

This consequently misled the decision maker into arriving at the wrong conclusion"

No, you really can't call an assessor a liar - as tempting as it is. I say things like 'they are mistaken', 'they have misremembered', 'they misheard', 'they misunderstood because they are not specialists in this area,' I like your example - but don't say I can only walk a few metres - say less than x - and don't just mention the pain, include any resting, breathlessness, shakiness and the fact that you cannot (or your friend can't) repeat the action all over again. It's fair enough to say that you believe they came to the wrong conclusion. (It made me smile!)

So glad your friend is fighting on. I have a feeling the two of you together will win through in the end. At least at a tribunal there will be someone who understands his difficulties.

Thanks for your reply and your comments. I'm so glad you approve of my approach ( the wrong conclusion etc). I believe this was key in winning my MR four years ago.

Hi All,

It seems that my friend has little extra evidence to put forward other than his own account of the assessment and possibly some extra input from his occupational health therapist.

I for one feel like this is possibly the best avenue as she is the one who sees his struggles whereas his GP or practice nurse don't see this. He is waiting for an e mail from her and will print this out to send off with the rest of his MR package on Friday.

I will be seeing him then and we can go through everything together and get it sent off.
