Cruella, Hope it's OK for me to comment here. We are sooo alike. I agonised over the descriptors. For me, DWP dug their heals in on food and mixing with people and would only give me prompting, which like you, was no good, BUT at Tribunal I got assistance for food and social support for mixing. I don't have anyone to help me. You don't need anyone, only the need, as Gordon says. In any case, you will accept your brother so that shows that the right person can help. Sounds like you have said all the right things, but unfortunately I think you might have to go to tribunal to get what you deserve. DWP is determined to get our money down. I'd get another letter from consultant. If he refuses then at least you have tried. Good luck with it. x

Mosala, never sure whose thread to post on, yours or mine! Thank you for your comment, think I will have to be strong and fight, having difficulty getting hold of my consultant which is frustrating. Yes, so similar, wondering how they perceived your going out, don't worry if you prefer not to say. Regarding OCD, they gave the the 10 point one as in cannot undertake a journey due to OPD. On my Review form, you could have taken it as the 12 point cannot follow a route without another person. I know you have similar to me as in OCD trigger obstacles preventing following a route. Curious whether they treated yours like mine.

On Wednesday, I was told by a DLA Case Worker that my records showed that I had not had an 'explanation' . This 'DLA' lady having looked through my claim said I needed an explanation why my preparing food points had been reduced from last award 3 years ago when condition not improved, but worsened, and also why they had mainly used/referred to old evidence and some new evidence (sent with Review form) seemingly ignored. So she sent through a task requesting 'explanation phone call to me' to the office dealing with my claim.
She said I would get a call back hopefully within 24 hours. I had not been rang back so today I rang the call centre, and said how I was still waiting for the 'explanation' call back and was told by the call handler that a specialist would be reading through my case/claim in order to give an explanation, but that this specialist phoning me back can take up to 3 days. Does this actually happen, a specialist reading through the whole case/claim and phoning back with an explanation? If so, is the up to 3 days accurate?
Or am I waiting for nothing?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Cruella
I do know of several people who have had calls back from the DWP giving explanations. Whether you will hear in three days - I cannot tell you. If you don't hear on Monday I would ring them on Tuesday.

Cruella, Replying on this thread is fine.
My request for tribunal resulted in DWP 'phoning' me to offer standard mobility. I declined. Then when I received the tribunal bundle, I noticed they were offering 10 points. Having spent so much time on this I decided to still go for the 12 mobility points. CAB thought it worthwhile. Pre-tribunal, DWP were prepared to give me 10 points, knowing that I do go out, alone. (but have to jump through hoops to do so) So, it seems the 10 point one is not about 'never' going out. I don't understand the difference between the 10 points and 12 points descriptor. They both apply to me. They just try to get away with the least award possible, whether applicable or not. Do you ever go out?
I got 12 points mobility after tribunal in that I need someone to assist me, looking out for my many triggers and so lessening my chance of going near one and getting overwhelmed as a result. I don't actually have anyone to help me though.
Regarding 'DLA' lady giving less points, well that is just them trying it on for commission. I wouldn't accept a phone call explanation. I would ask for it in writing. They obviously want it off record! I secretly recorded them when they phoned me. Probably have not phoned because there is no legal explanation! Keep fighting Cruella, you deserve PIP by the sounds of it!
