Cruella, In my opinion, you have got this far, it is better to continue rather than start again. The f2f is awful. They just lie and interrogate you like a prisoner. My first F2F lasted 3 hours.

CAB said most people fail at MR. I got standard DL at MR which surprised CAB. CAB will get you through the tribunal successfully, I am sure. If that fails, then you can still start again in the summer if need be.

My CAB wont help with tribunals, they said they don't have the funding. I don't know whether I could do it through a larger CAB elsewhere in the country. I could only do it by phone

My CAB don't have the funding to help with tribunal, I would only be able to do it by phone anyway, so wondering if any big CAB in another part of the country might help. So pleased you are still looking on here, I thought you might disappear for ten years! I need the PIP high rate really as I have a specialist mortgage based on this. I wish there was a way I could contact you, but glad you are still visiting the site, Thank you

If you phone the national CAB number, someone will answer anywhere in the country. I am sure they will help you.
I am lingering a little whilst my subscription still stands and want to support you as we are so similar.
I don't think you are allowed to put your email address on here. Maybe you are on Facebook? Did you see my other answer to you on the other thread?

I have just read the other thread which is interesting, thank you. Part of me still wants to fight but I feel so ill at the moment (in bed most of the time) and the MR deadline is tomorrow! Now that I have seen my main consultant's evidence letter get overlooked at the Review, it concerns me what would happen at MR, I could not manage financially if they took away my mobility points, and would not be able to manage even until the Appeal. In the summer, Mind went to the Supreme Court with a claimant'MM' about social support/prompting and definitions and how many mentally ill people have been getting the prompting points rather than the social support points. I am wondering whether this could lead to the DWP having to look over previous claims to see if claimants awarded properly??? But I still haven't got my head round the mixing with others and social support. Did you end up being awarded it on the basis of not mixing because of people being contamination threats/OCD triggers? Don't worry if you don't want to answer. I just can't believe I can't have more points for it, I can't really see many people being more restricted than I am with mixing with people. I go months seeing nobody but grocery delivery men, and even then I can't speak to them because I have to hold my breath and get away as quickly as possible in case they have germs. (I am naturally a sociable person and hate being like this). I got transferred to several Case Managers over the last week or so, they were negative about me receiving the assistance 4 points for preparing food, all with different takes on it, but one of them who was nicely honest and agreed my main consultant's letter had been overlooked by all also said I should push for higher points re mixing with people. I wish I felt mentally and physically stronger, but even if I surrender this time - i am going to contact the CAB, national, so that I get a feel for how to progress things if need be, whether now or in the future. I could never ever attend an assessment centre, so I definitely could not try again under the worsening condition/change of circumstances. So I guess it is now or never, well in three years time. The ironic thing is if I was not under constant reassessment, and was given ten year Award, I think I might just start to relax and be able to start getting better healthwise! I know you have had your condition a lot longer than me from previous post, so I would never get the ten years, - although my main consultant's letter they did not see did say nothing was helping in the way of treatments!

Cruella, Shingles is soooooo painful. You could always put in for MR to catch the deadline, which will give you time to speak to CAB and then you could still pull out if you wanted to I think. (you'd need to check that tho) (Gordon?) f2f and MD are a waste of time a lot of the time imo. Tribunal is the important one. Tribunal will see consultant's letter. Actually, one of my GP's letters was missing from the bundle and their file, which I then presented to the tribunal. They probably 'lost it' on purpose! Which level of mobility do you get? This is first time I have got 4 for food and 4 for social support (always prompting before). I didn't contest it last time cos I already had the 12 points on other stuff. Got assistance for food cos can't touch raw meat/root veg. Meat would need to be prepared away from my kitchen by someone else cos of all rituals involved to clean. Unacceptable and unreasonable time to do. Someone telling me to touch would not work. Social - afraid of what people will say to me. Talk about their lifestyle which usually involves my trigger majority of time, (as so many triggers) so feel contaminated, equals rituals/OPD. Need someone to reassure/calm. Prompting me to talk to someone wouldn't work cos it's about what they say. It's also about certain tradesmen contaminating me (from their clothes) without even talking, but 'I think' social care is more about the actual conversation. (Gordon?) If you refuse a f2f I don't think they will accept that. You are lucky to have avoided it so far. I've had OCD for 45 years. I'm 65. GP said unlikely to get better. Sounds to me like you should get 4 for food and 4 for social. Can't you phone CAB today? Hope this helps.

This is what the DWP guidance say about Mixing with Other People

This activity considers a claimant’s ability to engage with other people, which means to interact face-to-face in a contextually and socially appropriate manner, understand body language and establish relationships.

Activities 7 and 9 are not mutually exclusive. If claimants require support to engage with others under activity 9, as well as communication support under activity 7, then their needs must be considered under both activities.

Notes:
An inability to engage face-to-face must be due to the impact of impairment and not simply a matter of preference by the claimant.
Social support means support from another person trained or experienced in assisting people to engage in social situations, or someone directly experienced in supporting the claimant themselves (for example a family member or carer), who can compensate for limited ability to understand and respond to body language, other social cues and assist social integration. Most claimants with sensory impairments will be able to fully engage with others independently, however they may score on both activities 7 and 9 if, for example anxiety arising from their impairment means they reasonably require social support to engage with people generally.

Behaviour which would result in a substantial risk of harm to the claimant or another person must be as a result of an underlying health condition and the claimant’s inability to control their behaviour.

When considering whether claimants can engage with others, consideration should be given to whether they can engage with people generally, not just those people they know well.
If an individual cannot reliably complete an activity in the way described in a descriptor then they should be considered unable to complete it at that level and an alternative descriptor selected.
